Please read these Terms of Service (“Terms”) carefully. They form a binding agreement between you and blocfone® (“blocfone®”, “we”, “us” or “our”) and govern your purchase and use of our eSIM data products and related website and services (the “Service”), including our refund terms (Section 5). By purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
blocfone® is operated by blocfone LLC, a company headquartered in Atlanta, Georgia 30305, United States.
1. What we provide
blocfone® sells digital eSIM profiles — activation codes and/or QR codes — that provide prepaid mobile data service in the countries and regions described for each plan. Connectivity is delivered through mobile network partners, and the available coverage, plans, and pricing are described at the point of purchase. In its current form (the Beta release), the Service is offered through the blocfone® bot and mini app on Telegram, where you browse plans, pay, and receive your eSIM.
2. Delivery
eSIM profiles are delivered digitally inside Telegram. After your payment is confirmed, blocfone® provisions your eSIM and delivers your activation details — the QR code, activation code, and/or ICCID — to your chat with the blocfone® bot (your Telegram inline chat / mini app view). Where you have provided an email address, we may also send them by email. Delivery of your QR code and activation details to your Telegram chat is the point at which the eSIM is treated as delivered to you. You are responsible for saving your activation details and keeping them private: anyone who obtains your QR code or activation link may be able to install and use the eSIM, and we are not responsible for use of an eSIM by someone with whom you have shared, or who has otherwise gained access to, those details (including through your own Telegram account or device).
3. Eligibility and accounts
You must be old enough to enter into a binding contract in your jurisdiction to use the Service. If the Service offers accounts, you are responsible for the accuracy of the information you provide and for keeping your credentials secure. We collect only the information needed to deliver the Service, as described in our Privacy Policy.
4. Pricing, payment, and escrow
Prices are shown at the point of purchase, and the price shown when you order applies to that order. In the Beta release, you pay inside Telegram in USDC from your own wallet.
How the escrow smart contract works. To protect both sides, crypto payments are not sent straight to blocfone®. They pass through an on-chain escrow smart contract on Solana Mainnet:
- You pay into escrow. When you confirm an order, your wallet sends the USDC purchase amount to the blocfone® escrow contract, not to blocfone® directly. The contract holds (locks) the funds — at this stage they belong outright to neither party.
- We provision your eSIM. Our system orders the eSIM from our network provider and prepares your activation QR code.
- Delivery releases the funds. When your QR code and activation details are delivered to your Telegram chat, that delivery is recorded and the escrow contract releases the locked USDC to blocfone®. This delivery is the point at which the service is treated as supplied.
- Failure refunds you automatically. If the eSIM cannot be provisioned, or delivery does not occur within 24 hours, the escrow contract returns the locked USDC to the wallet you paid from. No separate refund request is needed. Because this protection is built into the contract itself, it does not depend on blocfone® remaining online: once the 24-hour deadline passes, the return of your funds can be triggered permissionlessly on-chain, and the contract can only ever send a refund back to the wallet you paid from.
The effect is that you are not relying on a bare promise to refund before you receive anything: if blocfone® fails to deliver, the contract itself returns your funds. Once the contract releases funds on delivery, the payment is final and on-chain, and any further refund is handled under Section 5.
The escrow runs on Solana Mainnet, and both the contract and its activity are publicly verifiable on-chain:
- the escrow program (smart contract) at GSytPHisX1ayTAENJb732DpxAhRue7wY6Js3okyfzFho, where every deposit, release, and refund is publicly recorded; and
- the blocfone® oracle wallet — the authority that confirms delivery and triggers release of the escrowed USDC — at 27DBWWoiEzbCF9D85rfvXxc4wxRCejuDsxwH7r4hSqBa.
On-chain transactions are public and, once released, irreversible and outside our control. You are responsible for paying from a wallet you control, for sending the correct asset and amount, and for any network fees.
5. Refunds
Because eSIMs are digital products supplied on delivery, the refund line is the moment your activation details are delivered to your Telegram chat.
Before delivery — refundable. If your eSIM has not yet been delivered to your Telegram chat (for example, provisioning failed or you cancelled first), you are eligible for a refund. You do not need to ask: the escrow contract described in Section 4 automatically returns the locked USDC to the wallet you paid from if delivery does not complete within 24 hours.
After delivery — generally non-refundable. Once your QR code and activation details have been delivered to your Telegram chat, the eSIM is treated as supplied and is generally not refundable, whether or not you have installed or used it. Plans are also non-refundable after their validity period expires.
Service that does not work. If an eSIM is faulty or does not provide the service described — and the issue is not caused by your device, settings, coverage limitations, or a carrier restriction outside our control — contact us and we will investigate and, where appropriate, re-provision or refund it.
How to request. For a problem with a delivered eSIM, email hello@blocfone.io with your ICCID or order reference and a short description of the reason. We aim to review requests within 5 business days and will let you know the outcome.
How refunds are paid. Refunds are made in crypto (USDC). Before delivery, the escrow contract returns your USDC to the wallet you paid from automatically. After delivery, the payment has been released and is final on-chain; any approved goodwill refund is made at our discretion, and because rates move and transactions are irreversible, the currency or amount may differ from what you sent. You are responsible for any network fees.
Your statutory rights. Nothing in this Section limits any non-waivable consumer rights you have under the law applicable to you. In particular:
- EEA and UK. Consumers normally have a 14-day right to cancel a distance purchase. For digital content delivered immediately, that right is lost once delivery begins, where you have given prior express consent to immediate delivery and acknowledged that you lose the right of withdrawal. By placing an order and choosing immediate delivery to your Telegram chat, you give that consent, and the right of withdrawal ends when your activation details are delivered to your Telegram chat. Your statutory rights in respect of faulty or non-conforming digital content are not affected.
- Other regions. Where local law (for example, the Australian Consumer Law or similar consumer-guarantee regimes) gives you guarantees that cannot be excluded, those guarantees continue to apply.
6. Device compatibility and your responsibilities
Before purchasing, you are responsible for confirming that your device:
- supports eSIM technology;
- is carrier-unlocked and not restricted from using third-party eSIMs;
- is compatible with the network frequencies used at your destination.
We are not responsible for carrier locks, region locks, device or operating-system faults, or incompatible hardware. Please use any compatibility tool we provide, or check with your device manufacturer, before buying.
After installing the eSIM, you must turn on Data Roaming for the blocfone® eSIM line in your device settings. Our eSIMs connect through local partner networks, which your device treats as roaming, so the service will not work unless Data Roaming is enabled for that line. Enabling it for the eSIM line does not affect your primary line, and you remain responsible for ensuring your primary line does not incur its own roaming charges.
7. Service limitations
eSIM data service depends on partner carriers and local network infrastructure. Accordingly:
- Coverage is provided on a best-effort basis; coverage maps are estimates and actual coverage may vary, and may be limited or unavailable in some areas.
- Speed, latency, and availability are not guaranteed and depend on network conditions, congestion, and carrier policies. Some plans apply throttling after a fair-use threshold, as indicated in the plan details.
- Most plans provide data only. Voice and SMS are not included unless a plan expressly states otherwise; internet-based calling and messaging apps can be used over data.
- Where a plan does include voice or SMS, emergency calling may not be reliably available in all locations. Do not rely on a blocfone® plan as your only means of reaching emergency services; always keep an alternative method available.
8. Acceptable use
You agree to use the Service only for lawful purposes and in line with these Terms. You may not use the Service to:
- carry out illegal activity of any kind, or activity that violates the laws applicable to you or at your location;
- commit fraud or misrepresent your identity to obtain service;
- interfere with, attack, or disrupt networks or infrastructure;
- engage in bulk or automated abuse, or resell the Service without our authorisation; or
- send spam or other unsolicited mass communications.
Sanctions and export compliance. You represent and warrant that you are not located in, ordinarily resident in, or a national of any country or region subject to comprehensive economic sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); that you are not named on any sanctions or restricted-party list maintained by the United States (including the Office of Foreign Assets Control), the EU, the UK, or the United Nations; and that you will not use the Service on behalf of any such person or in any such region. We do not offer the Service where doing so would breach applicable sanctions or export-control laws, and we may refuse, suspend, or terminate service as needed to comply with them.
We may suspend or terminate access without notice where we reasonably detect abuse or a breach of these Terms. No refund is due for service suspended or terminated for a breach of these Terms.
9. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms. In summary, we collect and keep only the information needed to deliver the Service, we do not sell personal information, and we disclose it to authorities only in response to valid, relevant legal or regulatory demands from a body with proper jurisdiction.
10. Intellectual property
The Service, including our website, software, branding, and content, is owned by or licensed to blocfone® and is protected by intellectual property laws. You may use it only as needed to use the Service for its intended purpose. If you give us feedback, you agree we may use it without obligation to you.
11. Third-party links and services
The Service may reference or link to third-party websites and services that we do not control. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms and privacy policies.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or available in any particular location.
13. Limitation of liability
To the fullest extent permitted by law:
No indirect damages. blocfone® will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunities, arising out of or relating to the Service.
Liability cap. blocfone®’s total aggregate liability for any and all claims arising out of or relating to the Service or these Terms will not exceed the amount you actually paid to blocfone® for the specific order giving rise to the claim. This is the maximum blocfone® will pay, however the claim is framed (whether in contract, tort, statute, or otherwise) and however many claims are brought.
Crypto and wallet losses. You are solely responsible for your cryptocurrency wallet, your private keys and seed phrase, your device, and the transactions you authorise. blocfone® does not take custody of, control, or have access to your wallet or keys. blocfone® is not responsible or liable for any loss, in whole or in part, that arises from or relates to:
- loss, theft, or compromise of your wallet, private keys, seed phrase, device, or login credentials, including through phishing, scams, fraud, malware, or social engineering;
- sending funds to an incorrect address, on the wrong network, in the wrong asset, or in the wrong amount;
- network, gas, or transaction fees, and failed, delayed, dropped, or stuck transactions;
- the operation, congestion, forking, reorganisation, downtime, or failure of any blockchain, wallet application, bridge, exchange, custodian, RPC provider, or other third party; or
- changes in the value or exchange rate of any cryptocurrency or token, including any de-pegging of a stablecoin.
These losses are not caused by blocfone® and are outside our control. Even where a loss occurs around the same time as, or otherwise appears connected to, a transaction with blocfone®, blocfone® is not liable for it unless it was directly caused by blocfone®’s own breach of these Terms or by a defect in the defined operation of the blocfone® escrow contract described in Section 4. Any matter outside that defined operation is not connected to blocfone® for the purposes of these Terms.
Non-waivable rights. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law applicable to you, including, where applicable, liability for death or personal injury caused by negligence, or for fraud.
14. Indemnification
You agree to indemnify and hold blocfone® harmless from claims, losses, and expenses arising out of your misuse of the Service or your breach of these Terms or of any law applicable to you.
15. Governing law, arbitration, and disputes
These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict-of-laws rules.
Informal resolution first. Before starting an arbitration or court proceeding, please contact us at hello@blocfone.io so we can try to resolve the matter. If it is not resolved within 30 days, either party may proceed as set out below.
Binding individual arbitration. Except for the carve-outs below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be seated in Atlanta, Georgia, and may, at your election, be conducted by telephone, by video, or on written submissions. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes will be arbitrated only on an individual basis. You and blocfone® each waive any right to bring or take part in a class, collective, consolidated, or representative action, and the arbitrator may not combine more than one person’s claims.
Carve-outs. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect intellectual property or to stop unauthorised access to or use of the Service.
Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@blocfone.io. Opting out does not affect any other part of these Terms.
Consumers outside the US. Where the mandatory consumer-protection law of your country of residence gives you the right to bring claims in your local courts, or limits or prohibits pre-dispute arbitration or class-action waivers (as is the case for many consumers in the EEA and UK), those rights prevail over this Section. Nothing in these Terms removes protections that cannot be waived under the law applicable to you, and consumers may bring proceedings in the courts of their place of residence where local law so provides.
16. Changes to these Terms
We may update these Terms from time to time. We will post changes here with a revised “Last updated” date. The version in effect at the time of your purchase governs that order; continued use of the Service after changes take effect constitutes acceptance of the updated Terms for future use.
17. General
Entire agreement. These Terms, together with our Privacy Policy and any terms presented to you at the point of purchase, are the entire agreement between you and blocfone® about the Service, and replace any prior understanding on that subject.
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them to an affiliate, or in connection with a merger, acquisition, financing, or sale of assets, and will give notice where required by law.
Force majeure. We are not liable for any failure or delay in performing the Service that is caused by events beyond our reasonable control, including acts of God, network or carrier outages, blockchain congestion or failure, governmental actions, or other force-majeure events.
Notices. We may give you notices through the blocfone® bot, by email where you have provided one, or by posting on our website.
