Please read these Terms of Service (“Terms”) carefully. They form a binding agreement between you and blocfone® (“blocfone®”, “we”, “us” or “our”) and govern your purchase and use of our eSIM mobile products and related website and services (the “Service”), including our refund terms (Section 5). By purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

blocfone® is operated by blocfone LLC, a company headquartered in Atlanta, Georgia 30305, United States.

1. What we provide

blocfone® sells digital eSIM profiles (activation codes and/or QR codes) that provide prepaid mobile service in the countries and regions described for each plan. Depending on the plan you choose, that service may be data only, or may include a mobile number with calls and texts as well as data. What each plan includes (its coverage, allowances, duration, the mobile providers behind it, and its price) is described at the point of purchase, and connectivity is delivered through mobile network partners.

The Service is offered through two channels: our web agent at go.blocfone.com, and the blocfone® bot and mini app on Telegram. In either, you can compare plans, sign for your order, pay, and receive your eSIM. Neither channel requires an account or a password. The wallet you pay from is how we recognise you.

blocfone® also offers eSIM top-ups: where available, you can add more allowance and/or validity to an eSIM you have already purchased. A top-up is applied to your existing eSIM (no new eSIM or re-installation is required) and takes effect as described at the point of purchase. Top-ups are paid in USDC through the same escrow process as eSIM purchases. Availability depends on your eSIM’s status with the network partner; for example, an expired eSIM cannot be topped up. Plans that include a temporary mobile number cannot be topped up at all; where that applies it is stated on the plan, and the top-up option is not offered.

2. Delivery

eSIM profiles are delivered digitally, in the channel you bought in. Once your payment is locked (see Section 4), blocfone® provisions your eSIM and delivers your activation details (the QR code, the activation code and server address, and/or the ICCID) to you in the web agent, or to your chat with the blocfone® bot. Where you have provided an email address, we may also send them by email.

That delivery is the point at which the eSIM is treated as delivered to you, and it is the event that releases your payment to blocfone®. Your funds are not released to us before your eSIM is in your hands.

You are responsible for saving your activation details before you leave the page or the chat, and for keeping them private: anyone who obtains your QR code or activation link may be able to install and use the eSIM. We are not responsible for use of an eSIM by someone with whom you have shared those details, or who has otherwise gained access to them, including through your own device, browser or Telegram account.

3. Eligibility and accounts

You must be old enough to enter into a binding contract in your jurisdiction to use the Service. If the Service offers accounts, you are responsible for the accuracy of the information you provide and for keeping your credentials secure. We collect only the information needed to deliver the Service, as described in our Privacy Policy.

4. Pricing, payment, and escrow

Signing for your order. Before you pay, you confirm your order by signing a short message with your wallet. The signature is free, is not a transaction, and moves no funds. It records that you chose that specific plan at that price, and that you accepted these Terms. We record the signed message, the wallet address that signed it, the version of these Terms you accepted, the language you read them in, and the time.

You agree that this signature is your electronic signature and has the same effect as a handwritten one, and you consent to receiving these Terms, your order confirmation and your activation details electronically. No identity document is needed to sign for a data plan or for a plan with a temporary number.

If we ever offer a plan that requires a verified identity credential (which would apply only to permanent numbers and to transferring an existing number in, neither of which is offered today), we will tell you before you buy, and the identity wallet you present that credential from will stay separate from the wallet you pay with.

Prices are shown at the point of purchase, and the price shown when you order applies to that order. You pay in USDC from your own wallet. In the web agent you can connect Phantom, Solflare, Backpack or Base; sign in with Google or Apple and have a Phantom wallet created for you; or pay by scanning a Solana Pay QR code. In the Telegram bot you pay from your own wallet in the same way. Available payment options may change, and the options open to you are shown at checkout. Whichever method you use, payment is in USDC and passes through the same on-chain escrow described below.

How the escrow smart contract works. To protect both sides, crypto payments are not sent straight to blocfone®. They pass through an on-chain escrow smart contract on Solana Mainnet. Two words are used precisely in these Terms: your payment is locked when the USDC has left your wallet and is held by the contract, belonging outright to neither party; it is released (that is, accepted by us) only once your eSIM has been delivered to you. We are not paid for an eSIM before it is delivered.

  1. You pay into escrow. When you confirm an order, your wallet sends the USDC purchase amount to the blocfone® escrow contract, not to blocfone® directly. The contract holds (locks) the funds. At this stage they belong outright to neither party.
  2. We provision your eSIM. Our system orders the eSIM from our network provider and prepares your activation QR code.
  3. Delivery releases the funds. When your QR code and activation details are delivered to you (in the web agent, or in your Telegram chat), that delivery is recorded and the escrow contract releases the locked USDC to blocfone®. This delivery is the point at which the service is treated as supplied.
  4. Failure refunds you automatically. If the eSIM cannot be provisioned, or delivery does not occur, the escrow contract returns the locked USDC to the wallet you paid from. No separate refund request is needed. Because this protection is built into the contract itself, it does not depend on blocfone® remaining online: once the 24-hour deadline passes, the return of your funds can be triggered permissionlessly on-chain, and the contract can only ever send a refund back to the wallet you paid from.

If Phantom creates a new wallet for you when you sign in, that wallet needs a tiny amount of SOL to be able to send any transaction on Solana. To make this easy, blocfone® covers that small network cost for you: we place a very small amount of SOL (worth only a few cents) into your new wallet, one time, so you can complete your purchase. It has no cash value, it’s provided as-is to help you use the Service, and we’re not responsible for what happens to it afterward.

The effect is that you are not relying on a bare promise to refund before you receive anything: if blocfone® fails to deliver, the contract itself returns your funds. Once the contract releases funds on delivery, the payment is final and on-chain, and any further refund is handled under Section 5.

The escrow runs on Solana Mainnet, and both the contract and its activity are publicly verifiable on-chain:

On-chain transactions are public and, once released, irreversible and outside our control. You are responsible for paying from a wallet you control, for sending the correct asset and amount, and for any network fees.

5. Refunds and service performance

5.1 Your payment. When you accept a plan, the terms you accepted, including the price, are recorded to your order. Your payment is held and is not released until we have confirmed your eSIM has been delivered to you.

5.2 If we cannot deliver. If your eSIM cannot be delivered, your payment is returned to you automatically. You do not need to ask us, and no time limit applies. Where the plan has not been issued, it returns to the provider unused.

5.3 If your eSIM never activates. If your eSIM is delivered but the provider’s records show it was never activated on a mobile network, and you contact us within 30 days of purchase, we will treat this as a non-delivery and refund you in full, unless the evidence demonstrates the plan was capable of activation and simply not installed.

5.4 If the service does not perform. If your eSIM activated but the service did not perform as described, contact us within 60 days of purchase. We will review the evidence available to us and may refund you in full or in part, depending on what that evidence shows. We assess each case individually.

5.5 The evidence we rely on. In reviewing a refund request we use the record of your acceptance of the plan terms, our record of delivery, and activation and usage records provided by the mobile provider. We retain these records for as long as applicable law and regulation require, and will explain our decision to you on request.

5.6 Payments in USDC. Payments made in USDC are direct transfers and cannot be reversed through a card scheme or bank. The refund routes described above are how we put things right, and we apply them on the same evidence however you paid.

5.7 Your legal rights. Nothing in this section limits or removes any right you have under consumer law that cannot be excluded by agreement, including any right to a remedy where digital content or a digital service does not conform to what was described.

5.8 Unused allowance. A plan is sold for its stated allowance and validity period, not by what you use. We do not refund allowance you did not use, or time remaining on a plan you stopped using.

5.9 Top-ups. A top-up is applied directly to your existing eSIM. If a top-up cannot be completed, your payment is returned to you automatically under clause 5.2, and nothing is added to your eSIM. Once the additional allowance or validity has been added, the top-up is treated as delivered, and clauses 5.4 to 5.7 apply to it as they apply to a plan.

5.10 How to request. For a problem with a delivered eSIM, email hello@blocfone.io with your ICCID or order reference and a short description of the reason. We aim to review requests within 5 business days and will let you know the outcome.

5.11 How refunds are paid. Refunds are made in USDC to the wallet you paid from. Because rates move and transactions are irreversible, the currency or amount may differ from what you sent. You are responsible for any network fees.

5.12 Your statutory rights. Nothing in this Section limits any non-waivable consumer rights you have under the law applicable to you. In particular:

  • EEA and UK. Consumers normally have a 14-day right to cancel a distance purchase. For digital content delivered immediately, that right is lost once delivery begins, where you have given prior express consent to immediate delivery and acknowledged that you lose the right of withdrawal. By placing an order and choosing immediate delivery (in the web agent or in your Telegram chat), you give that consent, and the right of withdrawal ends when your activation details are delivered to you. Your statutory rights in respect of faulty or non-conforming digital content are not affected.
  • Other regions. Where local law (for example, the Australian Consumer Law or similar consumer-guarantee regimes) gives you guarantees that cannot be excluded, those guarantees continue to apply.

6. Device compatibility and your responsibilities

Before purchasing, you are responsible for confirming that your device:

  • supports eSIM technology;
  • is carrier-unlocked and not restricted from using third-party eSIMs;
  • is compatible with the network frequencies used at your destination.

We are not responsible for carrier locks, region locks, device or operating-system faults, or incompatible hardware. Please use any compatibility tool we provide, or check with your device manufacturer, before buying.

After installing the eSIM, you must turn on Data Roaming for the blocfone® eSIM line in your device settings. Our eSIMs connect through local partner networks, which your device treats as roaming, so the service will not work unless Data Roaming is enabled for that line. Enabling it for the eSIM line does not affect your primary line, and you remain responsible for ensuring your primary line does not incur its own roaming charges.

7. Service limitations

Mobile service depends on partner carriers and local network infrastructure. Accordingly:

  • Coverage is provided on a best-effort basis; coverage maps are estimates and actual coverage may vary, and may be limited or unavailable in some areas.
  • Speed, latency, and availability are not guaranteed and depend on network conditions, congestion, and carrier policies. Some plans apply throttling after a fair-use threshold, as indicated in the plan details.
  • Plans differ in what they include. Some provide data only; others include a mobile number with calls and texts. What your plan includes is stated on the plan at the point of purchase. Internet-based calling and messaging apps can be used over data on any plan.
  • Numbers are temporary. Where a plan includes a mobile number, that number is assigned by the mobile network partner for the life of that plan. It cannot be transferred to another provider or kept when the plan ends, and once released it may later be reassigned to someone else. Do not use a blocfone® number as your only or long-term contact number, and do not use it to secure accounts or to receive one-time passcodes or other verification messages you will need access to after the plan expires.
  • Emergency calls. Where a plan includes calls, emergency calling may be unavailable or unreliably routed, and your location may not be passed to emergency services. Never rely on a blocfone® plan as your only means of reaching emergency services; always keep an alternative available.

8. Acceptable use

You agree to use the Service only for lawful purposes and in line with these Terms. You may not use the Service to:

  • carry out illegal activity of any kind, or activity that violates the laws applicable to you or at your location;
  • commit fraud or misrepresent your identity to obtain service;
  • interfere with, attack, or disrupt networks or infrastructure;
  • engage in bulk or automated abuse, or resell the Service without our authorisation; or
  • send spam or other unsolicited mass communications.

Sanctions and export compliance. You represent and warrant that you are not located in, ordinarily resident in, or a national of any country or region subject to comprehensive economic sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); that you are not named on any sanctions or restricted-party list maintained by the United States (including the Office of Foreign Assets Control), the EU, the UK, or the United Nations; and that you will not use the Service on behalf of any such person or in any such region. We do not offer the Service where doing so would breach applicable sanctions or export-control laws, and we may refuse, suspend, or terminate service as needed to comply with them. As described in our Privacy Policy, we screen the wallet address used for each order against published sanctions lists in order to meet these obligations.

We may suspend or terminate access without notice where we reasonably detect abuse or a breach of these Terms. No refund is due for service suspended or terminated for a breach of these Terms.

9. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these Terms. In summary, we collect and keep only the information needed to deliver the Service, we do not sell personal information, and we disclose it to authorities only in response to valid, relevant legal or regulatory demands from a body with proper jurisdiction.

10. Intellectual property

The Service, including our website, software, branding, and content, is owned by or licensed to blocfone® and is protected by intellectual property laws. You may use it only as needed to use the Service for its intended purpose. If you give us feedback, you agree we may use it without obligation to you.

11. Third-party links and services

The Service may reference or link to third-party websites and services that we do not control. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms and privacy policies.

12. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or available in any particular location.

13. Limitation of liability

To the fullest extent permitted by law:

No indirect damages. blocfone® will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunities, arising out of or relating to the Service.

Liability cap. blocfone®’s total aggregate liability for any and all claims arising out of or relating to the Service or these Terms will not exceed the amount you actually paid to blocfone® for the specific order giving rise to the claim. This is the maximum blocfone® will pay, however the claim is framed (whether in contract, tort, statute, or otherwise) and however many claims are brought.

Crypto and wallet losses. You are solely responsible for your cryptocurrency wallet, your private keys and seed phrase, your device, and the transactions you authorise. blocfone® does not take custody of, control, or have access to your wallet or keys. blocfone® is not responsible or liable for any loss, in whole or in part, that arises from or relates to:

  • loss, theft, or compromise of your wallet, private keys, seed phrase, device, or login credentials, including through phishing, scams, fraud, malware, or social engineering;
  • sending funds to an incorrect address, on the wrong network, in the wrong asset, or in the wrong amount;
  • network, gas, or transaction fees, and failed, delayed, dropped, or stuck transactions;
  • the operation, congestion, forking, reorganisation, downtime, or failure of any blockchain, wallet application, bridge, exchange, custodian, RPC provider, or other third party; or
  • changes in the value or exchange rate of any cryptocurrency or token, including any de-pegging of a stablecoin.

These losses are not caused by blocfone® and are outside our control. Even where a loss occurs around the same time as, or otherwise appears connected to, a transaction with blocfone®, blocfone® is not liable for it unless it was directly caused by blocfone®’s own breach of these Terms or by a defect in the defined operation of the blocfone® escrow contract described in Section 4. Any matter outside that defined operation is not connected to blocfone® for the purposes of these Terms.

Non-waivable rights. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law applicable to you, including, where applicable, liability for death or personal injury caused by negligence, or for fraud.

14. Indemnification

You agree to indemnify and hold blocfone® harmless from claims, losses, and expenses arising out of your misuse of the Service or your breach of these Terms or of any law applicable to you.

15. Governing law, arbitration, and disputes

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict-of-laws rules.

Informal resolution first. Before starting an arbitration or court proceeding, please contact us at hello@blocfone.io so we can try to resolve the matter. If it is not resolved within 30 days, either party may proceed as set out below.

Binding individual arbitration. Except for the carve-outs below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be seated in Atlanta, Georgia, and may, at your election, be conducted by telephone, by video, or on written submissions. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. Disputes will be arbitrated only on an individual basis. You and blocfone® each waive any right to bring or take part in a class, collective, consolidated, or representative action, and the arbitrator may not combine more than one person’s claims.

Carve-outs. Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or other equitable relief in court to protect intellectual property or to stop unauthorised access to or use of the Service.

Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing hello@blocfone.io. Opting out does not affect any other part of these Terms.

Consumers outside the US. Where the mandatory consumer-protection law of your country of residence gives you the right to bring claims in your local courts, or limits or prohibits pre-dispute arbitration or class-action waivers (as is the case for many consumers in the EEA and UK), those rights prevail over this Section. Nothing in these Terms removes protections that cannot be waived under the law applicable to you, and consumers may bring proceedings in the courts of their place of residence where local law so provides.

16. Changes to these Terms

We may update these Terms from time to time. We will post changes here with a revised “Last updated” date. The version in effect at the time of your purchase governs that order; continued use of the Service after changes take effect constitutes acceptance of the updated Terms for future use.

17. General

Entire agreement. These Terms, together with our Privacy Policy and any terms presented to you at the point of purchase, are the entire agreement between you and blocfone® about the Service, and replace any prior understanding on that subject.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign them to an affiliate, or in connection with a merger, acquisition, financing, or sale of assets, and will give notice where required by law.

Force majeure. We are not liable for any failure or delay in performing the Service that is caused by events beyond our reasonable control, including acts of God, network or carrier outages, blockchain congestion or failure, governmental actions, or other force-majeure events.

Notices. We may give you notices in the web agent, through the blocfone® bot, by email where you have provided one, or by posting on our website. For web agent purchases there may be no channel through which we can contact you after you leave the purchase page, so please save your activation details and any order reference at the time of purchase.
